              Rules & Regulations

All lots in the cemetery are sold in accordance with the provisions of the laws of the State of New York and shall not be used for any other purpose than as a burial place for dead human remains.

No interment shall be allowed without a permit being obtained from the Fort Plain Cemetery Association. At the time of applying for the permit, the following information must be provided:

                   Name of deceased

                  Age of deceased including birth date if known

                  Place of birth of deceased if known

                  Date of death with death certificate if available

                 Time and date of interment

                  If not an adult, the names of parent(s) or legal guardian(s) of deceased

Lot owners are prohibited from allowing interments on their lots for compensation

 

Full purchase price must be paid before a deed will be given or burial allowed

 

Except as provided for in Section 1513(c) of the Not-for-Profit Corporation law,

no lot owner may transfer his or her lot.

 

All lot owners are required to notify the cemetery of any change of address. All

notices required to be sent shall be sent to the last recorded address and such notices shall be deemed as adequate.

 

No interments on Sunday or Holidays. Interments on Saturday and for strict religious reasons are allowed at an increased fee approved by the Division of Cemeteries.

 

All persons shall be allowed access to the cemetery during posted and daylight hours observing all rules which are in effect in the cemetery.

 

No motor bikes allowed at any time in the cemetery.

 

No dog walking allowed at any time in the cemetery.

 

Funerals are allowed between 8 am and 3 pm to allow the workmen sufficient time to properly close the grave and remove the equipment before 5 pm.

The Fort Plain Cemetery Association reserves the right to remove all flowers, wreaths, or other decorations from lots as soon as they become unsightly. They also reserve the right to trim or remove any unsightly shrubs or trees from lot owners graves. All containers, not of a permanent nature, shall be removed by October 1st.

 

Flowers, plants, shrubs or trees may not be planted more than one foot (12”) from the top of the owner's lot or monument.

 

The Fort Plain Cemetery Association reserves the right to remove, after due notice to the lot owner, any embellishment, effigy, or inscription on the lot which, in the opinion of the majority of the trustees, is unsightly or dangerous. Furthermore,

lot owners shall not have enclosures about their lots such as hedges or fences. It shall be the duty of the superintendent with approval of a majority of trustees to have such enclosures removed.

 

Placing of glass vases or blocks as receptacles for flowers either artificial or live on graves or lots is prohibited.

 

Monuments of two grave lots shall not exceed 18” wide and 5 1/2' long. Only one monument shall be allowed on a lot and shall be set in accordance with the general plan of the cemetery. All bases of monuments shall be finished true and level so as to fit on foundations without wedging or sprawls.

 

Effective May 1, 2003, no monuments or markers shall be permitted which utilize colors other than those of natural stone. Permitted are monuments and markers constructed of granite, bronze, marble or other cut stone. Only scenes and lettering will be permitted in various colors, if approved by the board of trustees.

 

Any marker (other that those used as headstones) can not exceed 24” x 12” with a foundation not to exceed the size of the marker and flush with the ground.

 

After January 1, 1985, concrete vaults or concrete grave liners will be required for interments in all graves. In lieu of concrete vaults or grave liners, metal vaults or cut stone liners will be acceptable.

 

All foundations will be constructed under the direction of the cemetery superintendent and a work order must be filed and approved prior to any delivery of a monument. No monument shall be delivered until the foundation is installed and ready to receive the monument.

Interment of cremated remains will be permitted only in appropriate rigid receptacles such as wood, metal, plastic or concrete. Cremated remains will not be permitted to be scatted in any part of the cemetery.

 

No vault or mausoleum shall be built above ground without the permission of the Board of Trustees and then only in approved locations.

 

No mausoleum will be approved for construction by the Board of Trustees unless there is a sufficient endowment set up to provide adequate income to maintain the structure.

 

Heavy trucking or vehicular traffic shall be refused entrance to the cemetery, when in the opinion of the superintendent, injury to roads and driveways may result.

 

There can be no more that four cremations per single lot (providing there is sufficient area) or one casket burial and one cremation per single lot and only one monument per single lot.

 

Graves will not be opened (usually between December and April) when frost, weather and safety conditions warrant such a refusal except for strict religious reasons. If weather conditions allow, we will always attempt to accommodate a burial. During the winter season, bodies received for interment will be placed in the vault until conditions allow interment.

 

All bodies in the vault must be embalmed and those in wooden caskets must have the body wrapped in three or more layers of non-porous plastic.

 

Bodies left in the vault during the winter must be removed and interred by June 1st.

 

All bodies left in the vault after June 1st will be removed and interred. If not entitled to burial in a family plot, they will be interred in a single grave. The expense of this interment shall be borne by those who caused the body to be placed in the vault. Only such notice shall be given in this case as shall be practical under the circumstances.

 

Disinterment will be allowed between 7:30 am and 3 pm provided the proper fees have been paid as outlined in the provisions of Section 1510(e) of the Not for Profit Corporation Law.

 

All funeral processions and vehicles will be under the control of the superintendent while in the cemetery.

All work done in the cemetery shall be done by cemetery employees or contractors under the supervision of the cemetery superintendent. Contractors doing work in the cemetery must provide the superintendent or board secretary with a certificate of insurance.

 

These rules and regulations may be amended by the board of Trustees of the Fort Plain Cemetery Association, but no such amendments shall be effective until approved by the New York State Cemetery Board.
